TERRACOTTA DESIGN TERMS AND CONDITIONS

1. DEFINITIONS

  • "Terracotta" refers to Terracotta Design and its affiliated entities

  • "Design Services" means our professional biophilic design consultation and planning services

  • "Design Fee" refers to the payment required for our design services

  • "Plant Credit" means the credit equal to your design fee that can be applied to plant and pot purchases

  • "Client" refers to any individual or entity purchasing our design services

  • "SMS Program" refers to our text message communication service

2. DESIGN SERVICES AGREEMENT

2.1 Service Description

Terracotta provides professional biophilic design services for residential spaces. Our services include consultation, plant selection, placement recommendations, and ongoing support as specified in your chosen package.

2.2 Consultation Process

Design services begin with an initial consultation where we discuss your vision, space requirements, and preferences. Following this consultation, we develop a customized design plan according to your selected package.

2.3 Deliverables

Depending on your chosen package, deliverables may include:

  • Custom plant selection recommendations

  • Placement plans

  • Care guidelines

  • Ongoing support as specified in your package

2.4 Timeline

  • Initial consultation scheduling within 5 business days of booking

  • Design plan delivery within 10 business days of consultation

  • Revision periods as specified in your package

3. DESIGN FEE & CREDIT POLICY

3.1 Design Fee Structure

Design fees are required upfront and vary based on the package selected:

  • Single Space Design: $500

  • Multi-Room Design: $1,200

  • Full Home Design: $2,500

3.2 Credit Application

  • Your entire design fee becomes available as credit toward plant and pot purchases through Terracotta

  • Credit must be used within 60 days of design plan delivery

  • Credit is non-transferable and cannot be exchanged for cash

  • Credit applies to plants and pots only, not to additional services

  • No partial credit use - must be applied to a single order

4. PAYMENT TERMS

4.1 Payment Methods

We accept:

  • Major credit cards

  • Bank transfers

  • Digital payment services

4.2 Payment Schedule

  • Design fee due in full at time of booking

  • Plant and pot purchases can be paid for using design credit plus any additional amount due

4.3 Refund Policy

  • Design fees are non-refundable once the consultation has occurred

  • Cancellations more than 48 hours before consultation may receive a full refund

  • No refunds on plant or pot purchases unless damaged or defective

5. PLANT PURCHASE TERMS

5.1 Product Availability

  • Plant availability subject to seasonal and supplier variations

  • We reserve the right to suggest comparable substitutions if selected plants are unavailable

  • Pricing subject to change based on market availability

5.2 Plant Health Guarantee

  • 30-day health guarantee on all plants

  • Replacement or credit provided for plants that fail despite proper care

  • Guarantee void if care instructions not followed

5.3 Delivery Terms

  • Delivery available within Boulder, Colorado

  • Delivery fees calculated based on order size and location

  • Specific delivery windows will be scheduled in advance

6. CONSULTATION POLICIES

6.1 Scheduling

  • Consultations available during regular business hours

  • Weekend appointments subject to availability

  • 48-hour notice required for rescheduling

6.2 Cancellation Policy

  • 48-hour notice required for cancellation without penalty

  • Late cancellations subject to 50% fee

  • No-shows charged full consultation fee

7. DESIGN COPYRIGHT & USAGE

7.1 Ownership

  • All design plans remain intellectual property of Terracotta

  • Clients receive license for personal use only

  • Commercial use or reproduction prohibited without written permission

7.2 Client Rights

  • Right to implement design plan

  • Right to share design plan with contractors for implementation

  • No right to resell or distribute design plans

8. SMS MESSAGING PROGRAM TERMS

8.1 Program Description

By providing your mobile number, you agree to receive text messages from Terracotta regarding:

  • Appointment reminders

  • Design updates

  • Plant care tips

  • Order status updates

8.2 Opt-Out Instructions

  • You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

8.3 Additional Terms

If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to {support email address or toll-free number}.

  • Carriers are not liable for delayed or undelivered messages.

  • As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

9. PLANT CARE & MAINTENANCE

9.1 Care Instructions

  • Detailed care instructions provided with each plant

  • Following care instructions required for health guarantee

  • Additional care consultation available for purchase

9.2 Liability Limitations

  • Not responsible for plant failure due to improper care

  • Not liable for damage caused by plants to property

  • No liability for allergic reactions or pet-related incidents

10. PRIVACY & DATA

10.1 Data Collection

We collect and store:

  • Contact information

  • Design preferences

  • Purchase history

  • Space photos and measurements

10.2 Data Usage

Information used for:

  • Design planning

  • Order fulfillment

  • Customer service

  • Marketing communications (with consent)

11. GENERAL PROVISIONS

11.1 Modifications

  • Terms subject to change with notice

  • Changes effective immediately for new clients

  • Existing clients notified via email

11.2 Governing Law

  • Terms governed by Colorado law

  • Disputes subject to Colorado jurisdiction

  • Mediation required before litigation
